IMPORTANT LEGAL NOTICE — PLEASE READ THESE TERMS CAREFULLY BEFORE USING FISHBOWL. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

1. Introduction and Acceptance of Terms

These Terms and Conditions of Use (these “Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and FishBowl (“FishBowl,” “we,” “us,” or “our”), the operator of the website located at fishbowl.wtf and all related services, applications, and platforms (collectively, the “Service”).

By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service.

These Terms are effective as of March 22, 2026. We reserve the right to modify these Terms at any time in accordance with Section 18 below.

2. Eligibility Requirements

2.1 Age Requirement

The Service is intended solely for individuals who are at least eighteen (18) years of age. By accessing or using the Service, you represent and warrant that you are at least eighteen (18) years old. This is a strict eligibility requirement and is non-negotiable.

2.2 Legal Capacity

You represent and warrant that you have the legal capacity to enter into a binding agreement under the laws of your jurisdiction, and that your use of the Service does not violate any applicable law or regulation.

2.3 Age Misrepresentation

If you misrepresent your age to gain access to the Service:

  • Your account will be immediately and permanently terminated;
  • All associated data may be preserved and reported to law enforcement authorities as required or permitted by applicable law;
  • You (and, if applicable, your parent or legal guardian) shall be solely responsible and liable for all consequences arising from such misrepresentation, including but not limited to exposure to content and interactions intended only for adults.

2.4 Parental and Guardian Liability

If a minor gains access to the Service by misrepresenting their age or through any other means, the parent(s) or legal guardian(s) of such minor assume full responsibility and liability for: (a) the minor’s use of the Service; (b) any content the minor is exposed to; (c) any interactions the minor engages in; and (d) any violations of these Terms attributable to the minor. Parents and guardians are advised to monitor their minor children’s internet usage and to employ available parental control technologies.

3. Description of the Service

FishBowl is a live, interactive video and audio communication platform that connects users with other users in real time. The Service consists of the following core features:

3.1 Fish Roulette

Fish Roulette is a random one-on-one live video chat feature. Users are matched with random partners through an automated queue system. Users may engage in video, audio, and text-based communication during a session. Users may skip to the next available partner or end the session at any time.

3.2 Group Chat Rooms

Group Chat Rooms are user-created public or private video chat rooms that support up to fifty (50) members. Up to six (6) users may broadcast video and audio simultaneously on the “stage.” Rooms include text chat functionality, moderation tools, and a role-based permissions hierarchy (creator, moderator, viewer).

3.3 Nature of Interactions

IMPORTANT DISCLOSURE: You are interacting with random, unverified individuals. FishBowl does not verify the identity, age, background, or intentions of any user. You should exercise extreme caution when interacting with strangers on the Service and should never share personal identifying information.

4. Account Registration and Security

4.1 Registration

To access the Service, you must create an account by providing accurate, current, and complete information, including a valid email address, username, and password, or by authenticating through a supported third-party OAuth provider (Google, Facebook, or Discord). You agree to update your account information promptly to keep it accurate and complete.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to: (a) create a strong and unique password; (b) not share your account credentials with any third party; and (c) notify us immediately at support@fishbowl.wtf if you become aware of any unauthorized use of your account or any other breach of security.

4.3 One Account Per User

Each individual may maintain only one (1) active account. Creating multiple accounts to circumvent enforcement actions, bans, or any other restriction is strictly prohibited and constitutes grounds for permanent termination of all associated accounts.

4.4 Account Suspension and Termination

We reserve the right, at our sole discretion, to suspend, restrict, or terminate any account that: (a) contains false or misleading information; (b) violates these Terms; (c) poses a safety or security risk to the Service or its users; or (d) is subject to a valid legal or regulatory demand.

5. User Conduct and Prohibited Activities

You agree that your use of the Service shall at all times comply with these Terms and all applicable local, state, national, and international laws and regulations. The following conduct is strictly prohibited:

5.1 Illegal and Criminal Conduct

  • Transmitting, displaying, distributing, or soliciting child sexual abuse material (“CSAM”) in any form (absolute zero-tolerance policy);
  • Engaging in, soliciting, promoting, or facilitating any form of sexual exploitation or trafficking, including conduct prohibited under 18 U.S.C. §§ 1591, 2251, 2252, 2252A, 2421A, and related statutes;
  • Engaging in any activity that constitutes a criminal offense under federal, state, or local law;
  • Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity;
  • Facilitating, soliciting, or engaging in prostitution or the commercial sex trade through the Service;

5.2 Harmful and Abusive Conduct

  • Displaying, transmitting, or sharing nudity, sexual content, or sexually explicit material;
  • Harassing, threatening, stalking, bullying, or intimidating any other user;
  • Using hate speech, slurs, or discriminatory language based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic;
  • Engaging in conduct that is reasonably likely to cause emotional distress, fear, or psychological harm to another user;

5.3 Platform Integrity Violations

  • Spamming, advertising, or promoting commercial products or services without prior written authorization;
  • Using bots, scripts, automated tools, or any non-human means to access or interact with the Service;
  • Attempting to circumvent, disable, or otherwise interfere with any security, moderation, or enforcement features of the Service, including ban evasion;
  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Service;
  • Exploiting any bug, vulnerability, or technical deficiency in the Service;
  • Interfering with or disrupting the integrity or performance of the Service or its infrastructure;

5.4 Privacy Protections

  • Disclosing, sharing, or soliciting personal identifying information of any user, including real name, address, phone number, workplace, school, or financial information (“doxxing”);
  • Collecting, harvesting, or storing personal data of other users without their express consent and a lawful basis for doing so;
  • Using any recording of another user to harass, threaten, blackmail, extort, defame, or humiliate that user;
  • Recording or distributing any session involving suspected CSAM, a suspected minor, or any content that depicts illegal activity (users must report such content immediately rather than record it);

6. Recording Consent, Content Creation, and Monitoring

6.1 Universal Consent to Recording by Other Users

RECORDING CONSENT NOTICE — BY USING THE SERVICE, YOU EXPRESSLY AND KNOWINGLY CONSENT TO BEING RECORDED, SCREENSHOTTED, LIVESTREAMED, AND/OR CAPTURED BY OTHER USERS OF THE SERVICE.

This consent applies to all forms of capture, including but not limited to: screen recording, video capture, audio recording, screenshotting, livestreaming to third-party platforms, and any other method of recording or reproducing your video, audio, image, likeness, voice, or text communications during a session.

This consent covers all lawful purposes, including personal use, content creation, commercial publication, social media distribution, and any other use that does not violate these Terms or applicable law.

This consent is granted as a condition of your use of the Service. If you do not wish to be recorded by other users, do not use the Service.

6.2 Scope of Recording Consent

The consent granted under Section 6.1 constitutes your express, informed, prior consent to interception, recording, and disclosure of your communications on the Service by other users, for the purposes of all applicable federal and state wiretapping, eavesdropping, and electronic surveillance statutes, including but not limited to:

  • The federal Wiretap Act (18 U.S.C. §§ 2510–2522);
  • California Penal Code § 632 (California’s two-party consent statute);
  • Illinois Eavesdropping Act (720 ILCS 5/14-2);
  • Florida Security of Communications Act (Fla. Stat. § 934.03);
  • Washington State Privacy Act (RCW 9.73.030);
  • And all other analogous state statutes requiring one-party or all-party consent to recording of communications.

You acknowledge that FishBowl is a platform where interactions between strangers are inherently public in nature, that you voluntarily enter each session knowing that other participants may record, and that this consent is freely and knowingly given at the time you accept these Terms and again each time you enter a session on the Service.

6.3 Content Creation and Commercial Use

FishBowl permits and encourages users to create content based on their interactions on the Service, including for commercial purposes such as YouTube videos, TikTok content, Twitch streams, podcasts, and other media. By using the Service, you acknowledge and agree that:

  • Other users may record your video, audio, image, likeness, and voice during sessions for content creation and publication;
  • Recordings may be edited, compiled, commented upon, and published on third-party platforms without additional notice to you;
  • You have no right of prior review, approval, or compensation with respect to any recording made by another user during a session in which you participated;
  • Your sole remedy if you do not wish to be recorded is to exit the session or cease using the Service.

6.4 Prohibited Uses of Recordings

While recording is permitted, the following uses of recordings are strictly prohibited and constitute violations of these Terms:

  • Using a recording to harass, threaten, stalk, blackmail, extort, or intimidate any person;
  • Using a recording to facilitate doxxing (disclosing personal identifying information);
  • Distributing a recording that contains CSAM or any content depicting the sexual exploitation of a minor;
  • Distributing a recording in a manner that constitutes defamation, fraud, or intentional infliction of emotional distress under applicable law;
  • Using a recording to create non-consensual intimate imagery (“revenge pornography”) or deepfake content;
  • Using a recording for any purpose that violates applicable law.

Violations of this section will result in immediate account termination and may be referred to law enforcement.

6.5 In-Session Recording Notice

In addition to this contractual consent, FishBowl displays a persistent visual notice within the user interface each time a user enters a Fish Roulette session or joins a Group Chat Room, stating substantially: “Sessions may be recorded by other users.” This notice serves as an additional layer of informed consent at the point of use. Your continued participation in a session after this notice is displayed constitutes additional, contemporaneous consent to recording.

6.6 First-Time Recording Acknowledgment

During the initial account setup process, you are required to separately acknowledge and accept the recording consent provisions of these Terms through a standalone checkbox or acknowledgment prompt, distinct from the general Terms acceptance. This acknowledgment is logged with a separate timestamp, IP address, and version identifier. This first-time acknowledgment constitutes a specific, standalone expression of informed consent to recording by other users.

6.7 Platform Monitoring

In addition to user-to-user recording, all content transmitted through the Service—including video streams, audio streams, text messages, images, and metadata—may be monitored, reviewed, and analyzed by FishBowl, its employees, contractors, and automated systems (including artificial intelligence and machine learning tools) for the purposes of: (a) enforcing these Terms; (b) ensuring the safety of users; (c) detecting and preventing illegal activity; and (d) complying with applicable legal and regulatory obligations.

6.8 Automated Screenshot and Frame Capture

The Service may automatically capture screenshots, video frames, or other visual data during your use of the Service. Such captures may be retained and used for moderation review, evidence preservation, and legal compliance purposes.

6.9 Platform Recording

FishBowl reserves the right to record video, audio, and text communications transmitted through the Service for the purposes of: (a) moderation and enforcement of these Terms; (b) investigating reports and complaints; (c) preserving evidence of illegal activity; and (d) complying with law enforcement requests and legal obligations. Recordings may be retained for up to one (1) year or longer as required by law.

6.10 Third-Party Infrastructure

Your video and audio streams are routed through Agora, Inc.’s (“Agora”) infrastructure. This means your communications pass through third-party servers and are subject to Agora’s data processing practices and privacy policy in addition to these Terms. FishBowl does not operate peer-to-peer video connections. By using the Service, you acknowledge and consent to Agora’s processing of your video and audio data.

6.11 No Expectation of Privacy

YOU HAVE NO EXPECTATION OF PRIVACY IN ANY CONTENT TRANSMITTED THROUGH THE SERVICE. YOU SHOULD ASSUME THAT ANYTHING YOU DISPLAY, SAY, OR TYPE DURING A SESSION MAY BE CAPTURED, RECORDED, STORED, REVIEWED, AND DISCLOSED BY FISHBOWL, BY OTHER USERS, OR TO THIRD PARTIES INCLUDING LAW ENFORCEMENT, AS PERMITTED OR REQUIRED BY LAW. BOTH FISHBOWL AND OTHER USERS OF THE SERVICE MAY RECORD YOUR SESSIONS AT ANY TIME.

7. Child Sexual Abuse Material (CSAM) Policy and Law Enforcement Cooperation

7.1 Zero-Tolerance Policy

FishBowl maintains an absolute zero-tolerance policy with respect to child sexual abuse material (CSAM), child sexual exploitation, and any conduct that endangers a minor. Any content depicting, promoting, soliciting, or facilitating the sexual exploitation of a minor will result in immediate, permanent termination of the offending user’s account and referral to law enforcement.

7.2 Federal Reporting Obligations

As a provider of an interactive computer service, FishBowl is subject to mandatory reporting obligations under federal law. Specifically:

  • 18 U.S.C. § 2258A requires electronic communication service providers and remote computing service providers to report apparent violations involving CSAM to the National Center for Missing & Exploited Children (“NCMEC”) via the CyberTipline as soon as reasonably possible after obtaining actual knowledge of the material.
  • The REPORT Act (Pub. L. No. 118-52, signed into law May 7, 2024) expanded these obligations to additionally require reporting of apparent violations involving child sex trafficking (18 U.S.C. § 1591) and enticement of a minor (18 U.S.C. § 2422(b)).
  • The REPORT Act further extended the mandatory evidence preservation period from ninety (90) days to one (1) year for all materials associated with a CyberTipline report.

7.3 Evidence Preservation

Upon identification of suspected CSAM or child exploitation, FishBowl will: (a) immediately preserve all associated content, metadata, user data, and session information; (b) retain such evidence for a minimum of one (1) year, or longer as required by applicable law or upon request of law enforcement; and (c) produce such evidence to NCMEC, law enforcement, or pursuant to valid legal process.

7.4 Law Enforcement Cooperation

FishBowl will cooperate fully with law enforcement investigations relating to CSAM, child exploitation, sex trafficking, and any other criminal activity conducted through the Service. Such cooperation may include, without limitation: disclosing user account information, IP addresses, session data, communication logs, evidence captures, and any other data in our possession.

7.5 User Reporting Obligation

If you encounter any content or conduct on the Service that you believe involves CSAM, child exploitation, or a suspected minor using the platform, you must immediately: (a) report such content or conduct through the in-platform reporting tools; and (b) if appropriate, contact NCMEC directly at www.missingkids.org or 1-800-THE-LOST (1-800-843-5678), or your local law enforcement.

8. Compliance with FOSTA-SESTA

The Allow States and Victims to Fight Online Sex Trafficking Act of 2017 (“FOSTA,” Pub. L. No. 115-164), as enacted April 11, 2018, created exceptions to the immunity otherwise provided by 47 U.S.C. § 230 (Section 230 of the Communications Decency Act) for conduct that violates federal sex trafficking statutes (18 U.S.C. § 1591) and the federal prohibition on promotion or facilitation of prostitution (18 U.S.C. § 2421A).

FishBowl strictly prohibits the use of the Service to promote, facilitate, solicit, or engage in prostitution, sex trafficking, or any form of commercial sexual exploitation. Any user found to be engaging in such activity will be immediately and permanently banned, and all associated data will be preserved and reported to law enforcement and NCMEC as applicable.

9. User Assumption of Risk

By using the Service, you expressly acknowledge and accept the following inherent risks:

  • Exposure to Strangers. You will be connected with random, unverified individuals for live video and audio communication. FishBowl cannot and does not guarantee the identity, age, intent, criminal history, or mental state of any user.
  • Inappropriate or Harmful Content. Despite moderation efforts, you may be exposed to content that is offensive, obscene, violent, harassing, threatening, inaccurate, or otherwise objectionable.
  • External Recording. Other users may record, screenshot, or capture your video, audio, or text communications using tools outside of FishBowl’s control. You should assume that anything visible or audible during a session may be permanently recorded.
  • Personal Information Disclosure. You should never share personal identifying information during interactions. FishBowl is not responsible for any consequences arising from your voluntary disclosure of personal information.
  • Emotional and Psychological Harm. Interactions with strangers via live video may cause emotional distress, anxiety, or psychological harm. If you experience harassment, use the report and skip features immediately.
  • Minor Access. Despite age restrictions, minors may circumvent eligibility controls and access the Service. If you suspect you are interacting with a minor, immediately end the session and report the user.
  • Data Security. While FishBowl implements industry-standard security measures, no system is completely secure. Data breaches, unauthorized access, and security incidents remain possible.
  • Third-Party Processing. Your communications are routed through third-party infrastructure (Agora) and authentication may involve third-party providers (Google, Facebook, Discord), each with their own data practices.

YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SERVICE AND ALL INTERACTIONS WITH OTHER USERS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

10. Data Collection and Use

This section provides a summary of data practices. For complete details, please refer to our Privacy Policy.

10.1 Categories of Data Collected

  • Account Data: email address, username, display name, password (stored as a bcrypt hash), age, gender, country, biographical information, interests, profile images, and OAuth provider data (provider ID, email, name, avatar).
  • Usage Data: account creation metadata, terms acceptance history (including version, timestamp, and IP address), online status, last-seen timestamps, report history, friend connections, and credit score.
  • Technical Data: IP address, device information, user agent, browser type, session data, socket connection data, and WebRTC/STUN connection metadata.
  • Evidence Data: screenshots, video frame captures, and report-associated evidence, including metadata (capture timestamps, file sizes, integrity signatures, screen resolution).

10.2 Purposes of Data Use

Data collected is used for: (a) providing and operating the Service; (b) safety, moderation, and enforcement of these Terms; (c) compliance with legal and regulatory obligations, including mandatory CSAM and exploitation reporting; (d) responding to law enforcement requests and legal process; and (e) platform analytics and improvement.

10.3 Data Retention

User accounts and associated data are retained indefinitely until a deletion request is submitted and processed. Evidence data associated with CSAM or law enforcement reports is retained for a minimum of one (1) year pursuant to the REPORT Act, or longer as required by law. Transient operational data (e.g., queue positions, session tokens, cooldowns) is subject to automated expiration.

11. Third-Party Services and Integrations

The Service relies on and integrates with the following categories of third-party services:

Each third-party service is governed by its own terms of service and privacy policy. FishBowl is not responsible for the data practices, policies, or actions of any third-party provider. By using the Service, you acknowledge that your data may be processed by these third parties in accordance with their respective policies.

12. Advertising

The Service displays third-party advertisements, which may include advertisements served by Google Ads, Facebook Ads, and other advertising networks. These advertising providers may use cookies, web beacons, pixel tags, and similar tracking technologies to collect information about your browsing activity and interactions for the purpose of delivering targeted advertisements.

FishBowl does not control and is not responsible for the content of third-party advertisements or the data collection and tracking practices of advertising networks. Your interactions with third-party advertisements are governed by the respective advertiser’s terms and privacy policies.

13. Intellectual Property

13.1 FishBowl’s Intellectual Property

All content, features, functionality, software, code, design, graphics, trademarks, service marks, logos, and trade names associated with the Service are and shall remain the exclusive property of FishBowl or its licensors. Nothing in these Terms grants you any right, title, or interest in any such intellectual property except for the limited, revocable, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

13.2 User Content License

By transmitting, uploading, or otherwise making available any content through the Service (including video, audio, images, and text) (“User Content”), you grant FishBowl a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, store, distribute, and display such User Content solely for the purposes of operating, maintaining, improving, and ensuring the safety of the Service, and for complying with legal and regulatory obligations. This license survives termination of your account to the extent necessary for FishBowl to fulfill its legal obligations.

13.3 DMCA Notices

FishBowl respects intellectual property rights. If you believe that content on the Service infringes your copyright, please submit a notice pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512) to: support@fishbowl.wtf with the subject line “DMCA Notice.”

14. Enforcement and Moderation

FishBowl reserves the right, at its sole and absolute discretion, to take any of the following enforcement actions against any user, at any time, with or without prior notice:

  • Issuing a warning;
  • Removing or disabling access to content;
  • Temporarily muting a user in a Group Chat Room;
  • Temporarily or permanently banning a user from a specific Group Chat Room;
  • Suspending (pausing) an account;
  • Temporarily banning an account for a defined period;
  • Permanently banning an account;
  • Deleting an account;
  • Reporting user activity to law enforcement, NCMEC, or other relevant authorities;
  • Preserving evidence for legal proceedings.

Enforcement history, including ban records and reasons, is permanently recorded. FishBowl is not obligated to provide advance notice, a hearing, or an appeal process before taking enforcement action, except as may be required by applicable law.

15. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FISHBOWL EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
  • ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  • ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION ON THE SERVICE;
  • ANY WARRANTY REGARDING THE IDENTITY, AGE, OR INTENTIONS OF OTHER USERS;
  • ANY WARRANTY THAT THE SERVICE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

FISHBOWL DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY CONTENT, PRODUCT, OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL FISHBOWL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, REPUTATION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY ON THE SERVICE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (D) ANY CONTENT OBTAINED FROM THE SERVICE; OR (E) ANY OTHER MATTER RELATING TO THE SERVICE.

IN NO EVENT SHALL FISHBOWL’S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO FISHBOWL IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY (WHETHER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF FISHBOWL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, FISHBOWL’S LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

17. Indemnification

You agree to indemnify, defend, and hold harmless FishBowl, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law, regulation, or third-party right; (e) any dispute between you and another user; or (f) your negligence or willful misconduct.

FishBowl reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with FishBowl in the defense of any such claim.

18. Modifications to These Terms

FishBowl reserves the right to modify, amend, or update these Terms at any time, at its sole discretion. When we make material changes to these Terms, we will: (a) update the “Effective Date” at the top of this document; (b) post the revised Terms on the Service; and (c) make reasonable efforts to notify you of the changes (which may include in-app notifications, email notice, or a banner on the Service).

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to any revised Terms, you must immediately discontinue use of the Service and request deletion of your account.

We maintain a version history of these Terms. Your acceptance of each version is logged with a timestamp and IP address for compliance recordkeeping.

19. Dispute Resolution, Arbitration, and Class Action Waiver

19.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact FishBowl at support@fishbowl.wtf to attempt to resolve the dispute informally. The parties shall make good-faith efforts to resolve any dispute within thirty (30) days of receipt of the initial notice.

19.2 Binding Arbitration

If a dispute cannot be resolved informally, all claims arising out of or relating to these Terms or the Service shall be finally resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator in the English language. The seat of arbitration shall be the state in which FishBowl maintains its principal place of business, or such other location as the parties may mutually agree. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

The Federal Arbitration Act (9 U.S.C. §§ 1–16) shall govern the interpretation and enforcement of this arbitration provision.

19.3 Class Action Waiver

YOU AND FISHBOWL AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.

19.4 Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND FISHBOWL EACH WAIVE THE RIGHT TO A JURY TRIAL IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

19.5 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or data security. Additionally, claims arising under federal criminal statutes (including 18 U.S.C. §§ 1591, 2251, 2252, 2252A, 2258A, and 2421A) are not subject to arbitration.

19.6 Opt-Out Right

You may opt out of this arbitration and class action waiver provision by sending a written notice to support@fishbowl.wtf within thirty (30) days of first accepting these Terms. Your opt-out notice must include your full name, username, email address associated with your account, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, the remaining provisions of these Terms shall continue to apply.

20. Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles. To the extent that litigation is permitted under these Terms (e.g., for claims excluded from arbitration), you consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of Delaware.

21. Communications Decency Act Notice

FishBowl is a provider of an interactive computer service within the meaning of 47 U.S.C. § 230(f)(2). Pursuant to 47 U.S.C. § 230(c)(1), FishBowl shall not be treated as the publisher or speaker of any information provided by users of the Service. FishBowl may, in good faith, restrict access to or availability of material that it considers to be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, pursuant to 47 U.S.C. § 230(c)(2), without incurring liability for such action.

Nothing in Section 230 exempts FishBowl from its obligations under federal criminal law (47 U.S.C. § 230(e)(1)), including its CSAM reporting obligations under 18 U.S.C. § 2258A, or from its obligations under FOSTA (47 U.S.C. § 230(e)(5)).

22. Account Termination and Data Deletion

22.1 Termination by User

You may request deletion of your account at any time by sending an email to support@fishbowl.wtf with the subject line “Data Deletion Request.” FishBowl will process your request within thirty (30) calendar days.

22.2 Termination by FishBowl

FishBowl may suspend, restrict, or permanently terminate your account at any time, with or without cause, and with or without prior notice. Upon termination, your right to access and use the Service will immediately cease.

22.3 Post-Termination Data Retention

Following account deletion, FishBowl may retain certain data as required or permitted by law, including but not limited to: (a) data subject to mandatory preservation under the REPORT Act or other applicable law; (b) data necessary for fraud prevention or security purposes; (c) data subject to pending legal proceedings, disputes, or investigations; and (d) aggregated, de-identified data that does not personally identify you.

23. General Provisions

23.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and FishBowl with respect to the Service and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.

23.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms, and the remaining provisions shall continue in full force and effect.

23.3 Waiver

No failure or delay by FishBowl in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy preclude any other or further exercise thereof or the exercise of any other right, power, or remedy.

23.4 Assignment

You may not assign, delegate, or transfer these Terms or any rights or obligations hereunder without the prior written consent of FishBowl. FishBowl may freely assign these Terms without restriction. Any purported assignment in violation of this section shall be null and void.

23.5 Force Majeure

FishBowl shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond FishBowl’s reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, epidemics, government actions, power failures, internet disruptions, or failures of third-party service providers.

23.6 Notices

All notices under these Terms shall be in writing and shall be deemed given when sent by email to the addresses set forth in Section 24 below, or to the email address associated with your account.

23.7 No Third-Party Beneficiaries

These Terms are for the sole benefit of you and FishBowl and do not confer any rights or remedies upon any third party, except as expressly provided herein.

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICE, YOU CONFIRM THAT:

  1. You are at least eighteen (18) years of age;
  2. You have read and understand these Terms in their entirety;
  3. You understand and accept the inherent risks of interacting with strangers via live video;
  4. You consent to the monitoring, recording, and analysis of your activity on the Service by FishBowl;
  5. You expressly and knowingly consent to being recorded, screenshotted, livestreamed, and captured by other users of the Service, including for commercial content creation, as set forth in Section 6;
  6. You agree to the arbitration and class action waiver provisions;
  7. You agree to all terms, conditions, and policies set forth herein;
  8. Your electronic acceptance constitutes a valid and binding agreement equivalent to a handwritten signature pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. §§ 7001–7006) and the Uniform Electronic Transactions Act (UETA).
